FEDERAL JUDGE SENDS KANSAS SECRETARY OF STATE BACK TO LAW SCHOOL

The US Court Judges are the saviors
for American citizens against Trump
Well, what
have we learned about having Donald Trump as our Commander-in-Chief?
Unfortunately,
we have learned that the US Congress, that is supposed to be a check on the
Executive Branch, they are a bunch of wimps and will not challenge the
president. It doesn’t matter what the
issues are, in either immigration, separating immigrant children from their
parents or dealing with an EPA cabinet secretary that continually breaks all
the rules. Trump is never challenged.
Since the
Republicans run both congressional houses, the Democrats are powerless, at
least until the November mid-terms.
But we must
remember that there are three, not two houses in our democratic
government. So far, even the
conservative US Supreme Court and the other judges across the country, they are
the ones that have come to America's rescue.
It was the
courts that stopped Trump’s Muslim ban.
It was the courts in the different states that have been telling the
parties to stop the gerrymandering that allowed one party to always stay in
power. It was a judge that told Donald
Trump that his Trump University was a total farce and Trump ended up settling
the case with former students for 25 million dollars.
The courts of
the country have become our last resort for sanity, and hopefully Robert
Mueller’s special investigation will also send the president to court for
having to pay for his obstruction of justice, collusion, money laundering,
campaign donation fraud, or God knows whatever else of which he is most likely
guilty.
Well, now the
courts have once again put down a raging idiot that also happens to be the
current Republican, Secretary of State of the state of Kansas, Mr. Kris Kobach.
Kobach was one
of the primary individuals that worked with ALEC, the American
Legislative Exchange Council which is a nonprofit conservative
organization. ALEC was the group that produced a number of model bills for
states on a broad range of issues, such as the "Stand-your-ground" gun laws. This was the law that allowed the killer of
Treyvon Martin to walk away free. It is
referred to as the “License to Kill Law” and is totally supported by the NRA.
For years,
Kobach has been warning anyone that would listen, that voter fraud is so rampant
that restrictive laws are needed to prevent non-citizens from voting.
A legal
challenge to the Kansas law he championed requiring voters to show proof of
citizenship was his opportunity to back up his claims. Not only did he fail to
produce any credible evidence whatsoever, he also ended up being sanctioned by
a federal judge. This decision is a rebuke to Mr. Kobach and others who, like
him, traffic in xenophobia and lies about voter fraud.
A ruling
issued Monday by US District Judge, Julie A. Robinson, struck down the Kansas law
that went into effect in 2013 that required voters to produce proof of
citizenship, such as a passport or birth certificate, just for registering to
vote. The American Civil Liberties Union (ACLU) had filed suit on behalf
of the League of Women Voters and
individual Kansans. Instead of combating voter fraud, the judge found the law
had disenfranchised tens of thousands of eligible voters, violating the 1993 National Voter Registration Act and
the 14th Amendment.
The Kansas law
was uniquely strict in requiring documented proof of citizenship. However,
the ruling should serve as a warning to other states that try to erect
barriers to voting. The ruling’s
discrediting of Mr. Kobach is significant because of the national name he has
made for himself as chief supporter of voter-fraud claims and anti-immigration
noise. Kobach, a stanch ally of President Trump, who also served as vice
chairman of the very short-lived Presidential Advisory Commission on Election
Integrity. Mr. Kobach now hopes
to be the governor of Kansas, and he is running for the GOP nomination in an August primary. God help Kansas if he wins.
Voters would
do well to pay attention to the part of the 118-page ruling that
deals with Mr. Kobach’s improper conduct as both the defendant and the lawyer. So wanting was his representation that he violated all the
rules “designed to prevent prejudice”. Because of his conduct, the judge ordered Kobach to complete six hours of basic law school education.
Mr. Kobach
says he plans to appeal the judge’s ruling.
I would
suggest that “Lawyer Kobach” would do much better by attending the class
on the law.
